LEXARX FILES REEXAMINATION REQUEST ON BEHALF OF HPE AGAINST THIRD CLOUD BYTE PATENT

LexArx has filed a request for ex parte reexamination of U.S. Patent No. 9,651,320 with The United States Patent & Trademark Office on behalf of client Hewlett Packard Enterprise. The ‘320 patent is being asserted against HPE by Cloud Byte LLC in concurrent litigation in the Eastern District of Texas. LexArx previously filed reexamination requests for HPE against two other patents asserted in that litigation, both of which the Patent Office granted on all claims and all proposed substantial new questions of patentability.
