LexArx Secures Dismissal of Infringement Litigation Brought by Non-Practicing Entity

LexArx successfully defended a District of Utah patent infringement action filed by UBQS-IP LLC, a Pueblo Nuevo LLC non-practicing entity that has recently maintained an enforcement campaign in multiple jurisdictions. We first obtained UBQS’s voluntary dismissal of its indirect infringement claims and narrowing of its direct infringement claims through an amended complaint. We then filed a Rule 12(b)(6) motion to dismiss the amended complaint, asserting that it didn't plausibly allege infringement of any claim. Shortly after the motion was filed, UBQS dismissed the case.
