Daniel Valenzuela
Daniel Valenzuela is a registered patent attorney with a 20-year legal career, including extensive experience advising technology companies in complex patent litigation across the country and in post-grant proceedings before the U.S. Patent and Trademark Office.
Daniel’s practice spans the full lifecycle of patent disputes, including pre-suit assessment, invalidity and infringement contentions, motion practice, claim constructions, depositions, hearings, trials, and post-grant proceedings such as reexaminations and inter partes reviews (IPRs). His experience includes high-stakes matters with favorable outcomes, such as successful appellate briefing at the U.S. Supreme Court stage, a defense victory affirmed by the Federal Circuit following multiple post-grant challenges, including IPR and reexamination, and key victories on dispositive motions.
Daniel also advises clients on patent risk, licensing exposure, and pre-litigation strategy. His work involves analyzing third-party demand letters, assessing claim coverage against accused products, evaluating invalidity positions based on prior art, and developing strategic responses aligned with business objectives.
Drawing on his experience at international and national law firms, he has represented companies in matters involving a wide range of technologies, including software, cloud-based systems, telecommunications, medical devices, and consumer electronics.
Before entering private practice, he served as the sole law clerk and later staff attorney to the Hon. Mike Herrera of the 383rd District Court in El Paso County, Texas. While earning his electrical engineering degree, Daniel facilitated the design of a million-dollar project known as the Synchronous Optical Network (SONET) for the Texas Department of Transportation (TxDot) in El Paso, Texas.
He has been recognized as a Texas Super Lawyers Rising Star and received the Joseph A. Maley Pro Bono Award for his work on a civil rights matter.
